By booking photography services with AJ's Photography or using our website, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services or website.

Booking and Contracts

• All photography services require a signed contract and deposit to secure your date
• Contracts specify session details, deliverables, timeline, and pricing
• Services are provided subject to availability and confirmation
• We reserve the right to refuse service to anyone for any reason

Payment Terms

• Deposits are non-refundable and required to secure your booking
• Final payment is due according to your contract terms
• Late payments may result in delayed delivery of final images
• Additional fees may apply for services beyond the scope of your contract
• All prices are in USD and subject to applicable taxes

Cancellation and Rescheduling

• Cancellations must be made in writing (email acceptable)
• Deposits are non-refundable but may be applied to future sessions within one year
• Rescheduling is allowed subject to availability and may incur additional fees
• Weather-related cancellations will be rescheduled at no additional charge
• We are not liable for costs incurred due to cancellations or rescheduling

Copyright and Ownership

• AJ's Photography retains copyright to all images created during sessions
• Clients receive a license to use images for personal, non-commercial purposes
• Images may not be sold, used for commercial purposes, or modified without permission
• We grant clients the right to share images on social media with proper credit

Marketing and Portfolio Use

• We reserve the right to use images for our portfolio, website, and marketing
• Images may be used in professional competitions and publications
• Clients may opt-out of marketing usage by providing written notice
• We will make reasonable efforts to honor opt-out requests

• Provide accurate information for contracts and communications
• Arrive on time for scheduled sessions
• Ensure all participants have consent to be photographed
• Follow venue rules and photographer's directions during sessions
• Notify us of any special requirements or restrictions in advance
• Respect our equipment and working environment

• Image delivery timelines are specified in individual contracts
• Typical turnaround is 2-4 weeks for most sessions
• Rush delivery may be available for additional fees
• Images are delivered via secure online gallery
• Galleries remain active for a minimum of 6 months
• It is your responsibility to download images within the specified timeframe

To the maximum extent permitted by law:

• Our liability is limited to the total amount paid for services
• We are not responsible for missed shots due to circumstances beyond our control
• Equipment failure, technical issues, or other unforeseen circumstances may affect service delivery
• We carry professional liability insurance but are not liable for indirect or consequential damages
• Force majeure events (natural disasters, pandemics, etc.) may excuse performance obligations

Acceptable Use

• Use our website only for lawful purposes
• Do not attempt to gain unauthorized access to our systems
• Do not upload malicious code or attempt to disrupt our services
• Respect intellectual property rights of all content on our website

Third-Party Services

Our website may integrate with third-party services (payment processors, gallery providers, analytics). These services have their own terms of service and privacy policies. We are not responsible for third-party service failures or policies.

AJ's Photography adheres to professional photography industry standards including:

• Professional Photographers of America (PPA) Code of Ethics
• Industry-standard business practices and client relations
• Continuing education and professional development
• Proper licensing and insurance coverage

Any disputes arising from these Terms or our services shall be resolved through good faith negotiation. If resolution cannot be reached, disputes shall be subject to binding arbitration in Rowan County, North Carolina, under the rules of the American Arbitration Association.

We may update these Terms from time to time. Significant changes will be communicated via email or website notice. Continued use of our services after changes constitutes acceptance of updated Terms.

These Terms are governed by the laws of North Carolina, USA. Any legal proceedings shall be conducted in the courts of Rowan County, North Carolina.
